  • Featured Matter: Civil RICO Jury Verdict for Real Estate Developer

    Balestriere prosecuted federal racketeering and conspiracy claims on behalf of a real estate developer through a jury trial.

    The jury returned a verdict in the client’s favor, resulting in an award of treble damages and recovery of the client’s attorneys’ fees. The matter represents a rare plaintiff-side civil RICO jury victory and demonstrates the firm’s ability to investigate, develop, and try complex fraud and conspiracy claims.

    • Defended a high-profile business executive from highly publicized allegations of personal and business misconduct resulting in both a highly favorable litigation settlement as well as favorable media coverage for client. 

    • Represented real estate developers in a multi-jurisdictional dispute over ownership of a $200 million luxury resort, resulting in $75 million swing in value in favor of client. 

    • Won on multiple-victim sex trafficking trial, obtaining multi-million-dollar compensatory and punitive damages and fee awards. 

    • Prosecuted to arbitration evidentiary hearing financial service professional’s claims against major financial institution, catching a financial executive in perjury resulting in favorable outcome for client. 

    • Defended a services company at trial regarding payments due to state and local governments, obtaining a result where the government received a fraction of fees and penalties initially sought. 

    • Obtained complete reversal of a multi-million-dollar judgment against company and subsequently resolved complex trademark litigation for a minimal payment that was a fraction of the original judgment amount. 

    • Defended an art collector in a case involving conversion of paintings and breach of fiduciary duties by a New York gallery.  

    • Prosecuted malicious prosecution and defamation action to a jury verdict obtaining an award of damages more than sixty times the immediate pre-trial offer from the defendants.

    Prosecuted private fraud action to verdict at federal trial involving professionals defrauded in a complex tax and insurance scam, obtaining compensatory damages, punitive damages, and interest worth millions.
